Tour Terms and Conditions: (Agent-Organized Package Tours) Please read before travelling.
These Tour Terms and Conditions are part of the document explaining the terms and conditions of a transaction set forth in Article 12-4 of the Travel Agency Act and the contract document set forth in Article 12-5 of the same act.
1.Agent-Organized Package Tour Contract
- (1) The tour is organized, solicited, and operated by Hankyu Travel International Co., Ltd. [Japan Tourism Agency Commissioner registered travel agency No. 1847] ("Hankyu Travel," "we," "us," or "our"). By participating in this tour, you agree to enter into an Agent-Organized Package Tour Contract ("Tour Contract") with us.
- (2) We will make arrangements and manage itineraries so you can receive transportation, accommodations, and other tour-related services ("Tour Services") provided by transportation and accommodation facilities in accordance with the itinerary provided by us.
- (3) The contents and conditions of a Tour Contract are as specified in travel brochures, websites, these Tour Terms and Conditions, instructions given up until departure, travel documents, guidance and warnings, and other guides (collectively "Brochures, etc."), the final documents given to you prior to departure (finalized itinerary), and our Standard Terms and Conditions of Travel Contracts (Agent-Organized Package Tour Contracts).
2.Booking and Entering into a Tour Contract
- (1) You can book a tour through Hankyu Travel or any of the offices commissioned by Hankyu Travel (collectively "Our Company") by paying a deposit (all or part of the tour fee) in the amount specified in the Brochures, etc. The deposit will be used to cover part or all of the tour fee, cancellation fee, or penalty. A Tour Contract will be entered into upon approval and receipt of the deposit by Our Company. Specific tours, use of reward points, etc. are subject to the terms and conditions set forth separately in the Brochures, etc. You may be asked to fill out a prescribed paper or digital form with required information for our business processing purposes.
- (2) Our Company may accept your booking (i.e., request to enter into a Tour Contract) via telephone, mail, facsimile, internet, or other means of communication. In such cases, a Tour Contract has not yet been entered into at the time of booking and will be entered into when Our Company receives a deposit (all or part of the tour fee) by the date specified in the notification sent to you upon acceptance of your booking. If a deposit (all or part of the tour fee) is not paid by the specified date, your booking may be deemed not to have been made.
- (3) When a contracting person who represents a group of travelers who are to be on the same tour books the tour, Our Company will deem the said person to have all power of agency for the conclusion or cancellation of the contract.
- (4) The contracting person must submit a list of group members to Our Company by the date specified by Our Company. The contracting person will obtain the consent of the group members to the provision of information to third parties under Section 26.
- (5) If the contracting person does not accompany the group, Our Company will deem a group member selected by the contracting person in advance to be the contracting person after the start of the tour.
- (6) Our Company will not be responsible for any liabilities or obligations that the contracting person currently owes or may owe to the group members in the future.
3.Booking Terms and Conditions
- (1) Persons under the age of 15 at the time the tour starts must be accompanied by a guardian, unless they are participating in a specific tour (such as a language study tour for elementary and junior high school students). Please note that minors may not be allowed to participate in a tour due to the requirements of national laws, facility rules, etc.
- (2) In the case of tours that have special requirements, we may decline your booking if you don't meet the gender, age, qualification, skill, or other requirements specified by us.
- (3) If you are physically or mentally disabled (e.g., if you are deaf, visually impaired, unable to walk, or accompanied by a service dog, etc.), have a health problem (e.g., abnormal blood pressure, heart disease, chronic disease, food allergy, animal allergy, etc.), are or may be pregnant, or need special attention, please let us know at the time of booking. We will accommodate such needs to the extent possible and reasonable. We will contact you to ask you about your specific circumstances and needs that should be addressed during the tour. (Please let us know immediately if any of these conditions occur after you have entered into a Travel Contract with us.)
You are responsible for any costs incurred for special measures we take to meet your needs at your request. In order to conduct the tour safely and smoothly, we may require that you be accompanied by an aid or another person, submit a medical certificate from a doctor or prescribed documents as requested by public or other facility operators, or agree to change a part of the tour depending on the local situation or the conditions of the facilities to be used.
If we are unable to make arrangements for the measures requested by you, we may decline your booking or cancel your Tour Contract.
We may also decline your booking or cancel your Tour Contract depending on the local situation or the conditions of public or other service facilities. - (4) If we determine that you require a medical diagnosis or treatment by a physician during the tour due to illness, injury or other reasons, we will take necessary measures to ensure the smooth conduct of the tour. You are responsible for all costs incurred for taking such measures.
- (5) You may not deviate from the tour itinerary for personal reasons. However, changes may be made under separate terms and conditions depending on the tour. If you wish to deviate from the tour itinerary for personal reasons, you must notify us, the tour conductor, or the local attendant in advance along with information as to whether or not you will be returning.
- (6) If you fail to meet the tour group at the designated meeting place, such as a hotel or sightseeing site, at the designated meeting time, without notifying us, and if it is necessary to conduct a search, we may request relevant organizations to take necessary measures to search for you, in order to ensure your safety, regardless of whether or not you are accompanied by someone. In such cases, you will be responsible for the costs of the search.
- (7) We may decline your booking if we determine that you may cause an inconvenience to other travelers or interfere with the smooth conduct of group activities.
- (8) We may decline your booking in any of the circumstances described in (i) through (iii) below.
- (i) You are found to be a member of a crime syndicate, an associate member of a crime syndicate, a person affiliated with a crime syndicate, a company affiliated with a crime syndicate, a corporate racketeer, or involved in some other type of criminal organization.
- (ii) You make violent or unreasonable demands of us, act in a threatening way or use violence with regard to a transaction, or engage in similar conduct.
- (iii) You spread rumors or use fraudulent means or intimidation to discredit us, or engage in acts to interfere with our business, or engage in similar conduct.
- (9) Special waiting list contract
If you cannot enter into a Tour Contract because the tour is fully booked when you are trying to book a tour or due to other reasons, Our Company may, upon your request, enter into a special contract with you, which will enable you to enter into a Tour Contract with Our Company when it becomes available ("waitlisting").- (i) If you wish to be waitlisted, Our Company will accept your booking and the amount equivalent to the deposit after confirming how long you can wait for Our Company to respond to you. A Tour Contract has not yet been entered into at this time, and Our Company does not guarantee that the Tour Contract will be entered into in the future. You may be asked to fill out a prescribed paper or digital form with required information for our business processing purposes.
- (ii) Our Company will keep the amount equivalent to the deposit noted in (i) as an advance payment, and once it becomes possible to enter into a Tour Contract with you, we will notify you of its approval for the Tour Contract and apply the advance payment to cover the deposit.
- (iii) The Tour Contract will be entered into upon your receipt of a notice to the effect that the Tour Contract has been approved as a result of (ii).
- (iv) If Our Company does not approve the Tour Contract within the period in which you can wait for Our Company's response, Our Company will refund you the full amount of the advance payment.
- (v) If you request that Our Company remove you from the wait list before the expiry of the period in which you can wait for Our Company's response and before Our Company notifies you of its approval for the Tour Contract, Our Company will refund you the full amount of the advance payment. In such cases, Our Company will not impose the cancellation fee even if you request that your name be removed from the wait list during the period in which the cancellation fee is applicable.
- (10) We may decline your booking for any other business reasons.
4.Delivery of Tour Contract Document and Finalized Itinerary
- (1) We will deliver to you a contract document, containing an itinerary, the details of the Tour Services, other tour terms and conditions, and matters relating to our responsibilities, promptly after your booking, unless it has already been delivered to you upon booking. The contract document will be comprised of the Brochures, etc. noted in Section 1 (3) of these Tour Terms and Conditions. The scope of the Tour Services for which we are responsible for making arrangements and managing the itinerary under the Tour Contract is as specified in the Brochures, etc.
- (2) After delivering the Brochures, etc. noted in (1) of this section, we will give you a finalized itinerary, containing the finalized schedule, such as meeting places as well as the transportation and accommodation facilities to be used, by the day before the tour starts. (We will endeavor to deliver the finalized itinerary to you around 5 days before the tour starts.) However, we may deliver it to you on the day the tour starts if you make a booking 7 days or less before the day the tour starts. The finalized itinerary for one-day trips and some overnight trips may be included in the Brochures, etc. noted in (1) of this section. We will give you an update on travel arrangements upon request even before we give you the finalized itinerary.
5.Payment of the Tour Fee
- (1) The payment of the tour fee is due at least 22 days prior to the tour start date. If a booking is made after the due date, the payment is due on the date specified by us.
6.Tour Fee
- (1) The adult rate applies to persons aged 12 years or older, and the child rate applies to children aged 6 to 11 years unless otherwise specified. The infant rate applies to children aged 3 to 5 years for tours that include air travel. In all cases, age is as of the day the tour starts.
- (2) The tour fee is indicated for each tour. You can look up the fee by departure date and number of participants.
7.Final Tour Fee
- The "Final Tour Fee" refers to the "amount listed as the tour fee" on advertisements or Brochures, etc. plus "the amount listed as additional fees" minus "the amount listed as a discount." The total amount will be used as the basis for calculating the "cancellation fee" (Section 13 (1) [1]), the "penalty" (Section 14 (1) [1]) and the "compensation for changes" (Section 23).
8.What's Included in the Tour Fee
- (1) Fares and fees for transportation facilities, such as airlines, ships, railways, and buses, which are specified in the itinerary (Some tours offer class options and others use a particular class, which are specified in the Brochures, etc.)
- (2) Accommodation fees specified in the itinerary plus tax and service fees
- (3) Meals specified in the itinerary plus tax and service fees
- (4) Sightseeing fees specified in the itinerary
- (5) Necessary tour conductor expenses for tours accompanied by a tour conductor
- ● As a general rule, the above expenses are not refundable even if you choose not to use part of the relevant services.
9.What's Not Included in the Tour Fee
- Fees and expenses other than those specified in the preceding Section 8 are not included in the tour fee. Some examples include:
- (1) Excess baggage fees (for baggage in excess of the weight, size, and quantity allowance set by each transportation facility)
- (2) Laundry, telegram, telephone, additional meals and drinks and other expenses of a personal nature, as well as associated taxes and service fees
- (3) Fees for optional tours joined only by those who wish to take them (mini tours at an additional cost)
- (4) Travel costs to and from the arrival/departure points, such as to and from home and the airport, and accommodation costs for the day prior to the tour start date and for the day the tour ends
- (5) Passenger facility charge
- (6) Medical expenses for injuries and illnesses
- (7) Domestic travel insurance (optional insurance)
- (8) Expenses for shuttle services operated by facilities
- (9) Lodging tax and other taxes imposed on hotel rooms, etc.
- (10) Additional fares and fees imposed by transportation facilities (e.g., fuel surcharge)
- (11) Expenses required for measures taken when special needs arise
10.Changes to the Tour Contract
- (1) In the event of a natural disaster, war, riot, an order of a public agency, suspension of services provided by transportation and accommodation facilities, etc., the provision of transportation services that differ from the original schedule, or other circumstances beyond our control, we may make changes to the itinerary, Tour Services, and other details of the Tour Contract, even after the Tour Contract has been entered into, if such changes are absolutely necessary in order to ensure the safety and smooth conduct of the tour. In such cases, we will promptly provide you with an advance explanation of the reason why such a circumstance is beyond our control as well as how it affects the tour.
However, said explanation may be made after the changes have been made in the case of an emergency. - (2) The Agent-Organized Package Tour products planned and offered by Hankyu Travel use inclusive tour (IT) fares for airline tickets, unless otherwise stated in the Brochure, etc. The use of IT fares requires passengers to fly all routes covered in the tour. If you don't use the return flight or any flight included in the tour due to personal reasons, you may be charged a standard one way fare, etc. in accordance with the airline's fare conditions and regulations.
11.Changes to the Tour Fee
- We will not change the amount of the tour fee, additional fees, or a discount after the Tour Contract has been entered into, except in the following cases.
- (1) In the event that significant fluctuations in economic conditions cause transportation facilities to make significant revisions in their fares and fees beyond that which could normally be expected, we will revise the tour fee only by the difference between the fares before and after such revisions. However, when the tour fee is to be increased, we will notify you at least 16 days prior to the tour start date.
- (2) If the cost required to conduct the tour is reduced after its contents have been changed in accordance with the preceding Section 10, we will revise the tour fee only by the cost difference.
- (3) If, after the contents of the tour have been changed in accordance with the preceding Section 10, the cost required to conduct the tour (including cancellation fees, penalties, and other fees that have already been paid or are due to be paid for the Tour Services that will not be provided due to the changes) is reduced or increased, we will revise the tour fee only by the cost difference, except in the case of changes made due to overbooking, where there are insufficient seats, rooms, or other facilities, even though the transportation and accommodation facilities are providing services as usual.
- (4) If a statement that claims that the tour fee varies depending on the number of travelers using transportation and accommodation facilities is included in the Brochures, etc., we will change the tour fee within the range specified in the Brochures, etc. in the event that the number of travelers changes after the Tour Contract has been entered into due to reasons not attributable to us.
12.Change of Tour Participants
- (1) You may, with our consent, transfer your status under the Tour Contract to a third party. In such cases, you will need to fill out the paper or digital form specified by us with required information and will be charged a handling fee in the specified amount. If airline tickets have already been issued, you may be charged an additional fee for re-issuing the tickets.
- (2) The transfer of status under the Tour Contract will become effective upon our consent, and the third party to whom the status under the Tour Contract is transferred will succeed all of your rights and responsibilities under the Tour Contract.
- (3) We may not be able to consent to changing the tour participants due to reasons such as the registration of travelers' names with the providers of Tour Services. In such cases, you will need to cancel the Tour Contract you entered into with us as set forth in the following section, and the third party to whom the status under the Tour Contract is to be transferred will enter into a new Tour Contract with us in accordance with these terms and conditions.
- (4) If domestic travel insurance coverage is necessary, it has to be purchased separately.
13.Cancellation of Tour Contract and Refunds

(1) Cancellation before the start of the tour
- [1] You may cancel the Tour Contract at any time by paying the cancellation fee set forth below. The "Tour Contract Cancellation Date" in the schedule below is the day when we confirm the cancellation request you have made during Our Company's business hours on a business day.

- [2] Regardless of the provisions of Section 13 (1) [1], you may cancel your Tour Contract prior to the start of the tour without paying a cancellation fee in any of the following cases. In such cases, we will refund the full amount of the tour fee (or deposit) that has already been paid.
- (a) The contents of the contract have been changed. However, this is applicable only when the change is any of those listed in the left side column of the schedule in Section 23 or other significant changes.
- (b) The tour fee has been increased in accordance with Section 11 (1).
- (c) A natural disaster, war, riot, an order of a public agency, suspension of services provided by transportation and accommodation facilities, etc., or other circumstances make it, or are very likely to make it, impossible to conduct the tour safely and smoothly.
- (d) We failed to deliver the finalized itinerary to you by the date specified in Section 4.
- (e) The tour cannot be conducted according to the itinerary specified in the Brochures, etc. due to reasons attributable to us.
- [3] When the Tour Contract is canceled in accordance with (1) [1] of this section, we will refund the tour fee that has been paid after deducting a predetermined cancellation fee.
- [4] If you choose not to receive part of the Tour Services or leave the tour early, you will be deemed to have waived your rights and will not be entitled for any refunds.
- [5] Changing the departure date or tour, or partially changing the transportation and accommodation facilities included in the itinerary after entering into the Tour Contract due to personal reasons (including a change of the flight and seat class to be used in case of Tour Contracts that use individual excursion fares or individual inclusive tour fares offered by airline companies including LCCs)

(2) Cancellations after the start of the tour
- [1] If you choose not to receive part of the Tour Services or leave the tour early, you will be deemed to have waived your rights and will not be entitled for any refunds.
- [2] If, due to reasons not attributable to you, you are unable to receive part of the Tour Services specified in the Brochures, etc., or are informed by us as such, you may cancel part of the contract for the services you are unable to receive, without paying a cancellation fee. In such cases, we will refund you the portion of the tour fee for the services you are unable to receive. However, if the reason is not attributable to us, we will refund you the said amount after deducting cancellation fees, penalties, and other fees that have already been paid or are due to be paid for the relevant Tour Services.
14.Cancellation of Tour Contract by Us
- (1) Cancellation before the start of the tour
- [1] We may cancel your Tour Contract if you fail to pay the tour fee by the due date set forth in Section 5. In this case, you will be charged a penalty in the amount equivalent to the cancellation fee specified in Section 13 (1) [1].
- [2] We may cancel your Tour Contract in any of the cases (a) through (h) below.
- (a) It is found that you do not meet the gender, age, qualification, skill, or other requirements for participating in the tour specified by us in advance.
- (b) You are deemed not fit for the tour for such reasons as illness, the absence of a necessary aid, or other reasons that include those listed in Section 3 (4).
- (c) You are deemed to likely cause an inconvenience to other travelers or interfere with the smooth conduct of group activities.
- (d) You make excessively burdensome and unreasonable demands in relation to the contract contents.
- (e) It is found that you fall under any of the descriptions provided in (i) through (iii) of Section 3 (8).
- (f) The number of tour participants falls short of the minimum number of participants noted in the Brochures, etc. In such cases, we will notify you of the tour cancellation at least 14 days (4 days in the case of a one-day trip) prior to the tour start date.
- (g) The required conditions for conducting the tour specified by us in advance are, or are very likely to be, unmet, such as insufficient snowfall for ski tours.
- (h) A natural disaster, war, riot, an order of a public agency, suspension of services provided by transportation and accommodation facilities, etc., or other circumstances beyond our control make it, or are very likely to make it, impossible to conduct the tour safely and smoothly in accordance with the itinerary provided in the Brochures, etc.
- [3] When the Tour Contract is canceled in accordance with (1) [2] of this section, we will refund you the full amount of the tour fee that has been paid.
- (2) Cancellation after the start of the tour
- [1] In any of the following cases, we may cancel part of the Tour Contract, even after the tour has started, after providing you with a reason for such cancellation.
- (a) You are deemed not fit to continue the tour for such reasons as illness, the absence of a necessary aid, or other reasons that include those listed in Section 3 (4).
- (b) You fail to follow the instructions given by the tour conductor for the safe and smooth conduct of the tour, or assault or intimidate the tour conductor or fellow travelers, disturbing the order of group activities and hindering the safe and smooth conduct of the tour.
- (c) It is found that you fall under any of the descriptions provided in (i) through (iii) of Section 3 (8).
- (d) A natural disaster, war, riot, an order of a public agency, suspension of services provided by transportation and accommodation facilities, etc., or other circumstances beyond our control make it impossible to continue the tour.
- [2] Effect of cancellation and refunds
- If we cancel the Tour Contract in accordance with (2) [1] of this section, the contractual relationship between you and us will cease to exist upon cancellation. Our obligations with regard to the Tour Services already received by you will be deemed as having been fulfilled. In such cases, we will refund you a portion of the tour fee after deducting the amount of the cancellation fees, penalties, and other fees we have already paid or will pay to the providers of the Tour Services from the costs related to the Tour Services you have not yet received.
- [1] In any of the following cases, we may cancel part of the Tour Contract, even after the tour has started, after providing you with a reason for such cancellation.
- [3] When we cancel the Tour Contract in accordance with (2) [1] (a) and (d) of this section, we will make the necessary arrangements for you to return to the point of departure upon request. You will be responsible for all costs required for such arrangements.
15.Refund of the Tour Fee
- (1) If the tour fee is reduced in accordance with the provisions of Section 11, or if your Tour Contract is cancelled either by you or us in accordance with the provisions of Sections 13 and 14, resulting in an amount which should be refunded to you, we will refund you the said amount within 7 days after the date of the cancellation in the case of a refund due to a cancellation before the start of the tour, or within 30 days after the end date of the tour specified in the contract document in the case of a refund due to a reduction in the tour fee or a cancellation after the start of the tour. In cases where an amount needs to be refunded to a traveler with whom we have entered into a contract by correspondence as set forth in Section 24, we will refund the said amount to the traveler in accordance with the member regulations of the affiliated credit card company.
- (2) Nothing in (1) of this section will prevent you or us from exercising our right to claim damages pursuant to Section 19 (Our Liability) or Section 21 (Your Liability).
- (3) If coupons, airline tickets, JR tickets, etc. have been issued to you, you need to submit them to receive a refund, otherwise a refund may not be given.
16.Itinerary Management
- We will conduct the following operations and make efforts to ensure your safety and the smooth conduct of the tour.
However, if we have entered into a special contract with you that stipulates otherwise, the following may not apply. - (1) If you are deemed unlikely to be able to receive the Tour Services during the tour, we will take necessary measures to ensure that you will receive the Tour Service as specified in your Tour Contract.
- (2) If we must change the contents of the contract even after taking measures specified in (1) of this section, we will arrange alternative services. If we change the itinerary in such cases, we will make efforts to make the revised itinerary meet the aims of the original itinerary. Furthermore, if we change the contents of the Tour Services, we will make such efforts as to make the revised Tour Services similar to the original Tour Services, in order to keep any change to the contents of the contract to a minimum.
- (3) We may take necessary measures if you are deemed in need of assistance due to illness, injury, etc. during the tour. In such cases, you will be responsible for the cost required for the measures taken if the need for assistance is not due to a reason attributable to us, and you must pay the said cost by the date and the method specified by us.
17.Instructions
- You agree to follow instructions given by us for the safe and smooth conduct of the tour during group activities from the start to the end of the tour.
18.Tour Conductors, etc.
- (1) Whether or not a tour is accompanied by a tour conductor is specified in the Brochure, etc.
- (2) In the case of a tour accompanied by a tour conductor or a local tour conductor, the tour conductor or local tour conductor will carry out all or part of the operations necessary for the smooth conduct of the tour as well as other operations we deem necessary.
- (3) As a general rule, the tour conductor is on duty from 8:00 a.m. to 8:00 p.m.
- (4) If your tour is not accompanied by a tour conductor, you will be responsible for going through the necessary travel procedures yourself using the coupons delivered to you to receive the Tour Services.
- (5) In cases where the Tour Services must be altered due to inclement weather or other conditions during portions of the tour not accompanied by a local tour conductor, you will be responsible for arranging alternative services or going through the necessary procedures yourself.
- (6) Some tours may be accompanied by a staff member who is a qualified tour conductor and has long experience as a bus guide, and he/she will serve as both the tour conductor and the bus guide.
19.Our Liability and Exemptions
- (1) In meeting our obligations under the Tour Contract, we will compensate you for any damage caused to you by us or a party ("Agent") who is appointed by us to act as our agent for making travel arrangements, either intentionally or through negligence.
- (2) The provision of (1) in this section is effective only in cases where we are informed of such damage within 2 years after the day of its occurrence.
- (3) We will not be liable for any damage incurred by you as stipulated in (1) of this section due to reasons beyond our or our Agent's control, which include, but are not limited to, those listed below, unless willful misconduct or negligence on our or our Agent's part has been proven.
- (a) A natural disaster, war, riot, or any resulting tour itinerary alterations or tour cancellation
- (b) Suspension of services provided by transportation and accommodation facilities, etc., or any resulting tour itinerary alterations or tour cancellation
- (c) An order of a public agency, isolation resulting from an infectious disease, or any resulting tour itinerary alterations or cancellation
- (d) Accidents occurring during the free time
- (e) Food poisoning
- (f) Theft
- (g) Delays, stoppages, changes in schedules or routes by transportation facilities, or any resulting tour itinerary alterations or shortened stays at destinations
- (h) Accidents and fires involving transportation or accommodation facilities
- (4) We will compensate you for any damage to your baggage caused pursuant to (1) of this section only if we are informed of such damage within 14 days after the day of its occurrence. However, regardless of the amount of damage, we will pay only up to 150,000 yen per person for compensation (unless the damage is due to our willful misconduct or gross negligence).
20.Special Compensation
- (1) Regardless of whether or not we are liable in accordance with the preceding section, in the event that you are physically injured due to a sudden and unexpected external event in the course of the package tour, we will pay compensation in accordance with the provisions of the Special Compensation Rules of the Standard Terms and Conditions of Travel Contracts. Such compensation includes up to a maximum of 15 million yen for death or residual disability incurred; a solatium of 20,000 to 200,000 yen for hospitalization depending on the length of hospital stay or a solatium of 10,000 to 50,000 yen for outpatient treatment of three days or more, whichever is higher; and up to a maximum of 150,000 yen for damage to baggage (provided that the maximum compensation for a single item or pair of items is 100,000 yen). However, you will not be deemed to be participating in the tour on the days for which the itinerary clearly states that no Tour Services arranged by us will be provided, as long as it clearly states that no compensation will be paid for any damage incurred by you on such days. Furthermore, compensation will not be paid for cash, credit cards, valuables, drugs, cosmetics, consumables such as food and drink products, photographic film that has been shot, and manuscripts, etc. stored on recordable media.
* These provisions do not apply to medical expenses for treating injuries due to accident, expenses related to death or medical treatment due to illness, compensation for damages, expenses for rescuers, etc. - (2) We will not pay compensation or provide a solatium as stipulated in (1) of this section when damages result from your willful negligence, willful violation of law, or the receiving of illegal services, driving while intoxicated, illness, pregnancy, childbirth, premature birth, or miscarriage. The same restriction applies to accidents occurring during dangerous activities that are not included in the Agent-Organized Package Tour and engaged in during your free time, including, but not limited to, mountain climbing (using mountain climbing equipment such as ice axes, crampons, ropes, and hammers), riding a luge or bobsleigh, skydiving, hang gliding, riding ultralight aircraft (motor hang glider, microlight aircraft, ultralight aircraft, etc.), or gyroplane, as well as in the case of accidents due to earthquakes, volcanic eruptions, or tsunamis, or any disorder or confusion following such events. However, this does not apply in cases where such activities are included in the itinerary.
- (3) Even in cases where we are obligated to pay compensation in accordance with (1) of this section and liable for damages in accordance with the preceding section, if either of the said obligations has been fulfilled, both the obligation to pay compensation and the liability for damages will be deemed to have been fulfilled to the extent of the maximum compensation amount.
21.Your Liability
- (1) You will be liable for any damage incurred by us due to your willful misconduct, negligence, conduct that violates law, public order, and morals, or breach of provisions of our Agent-Organized Package Tour Contract.
- (2) You agree to make every effort, using information we provide, to understand the details of your rights, obligations, and other details of your Tour Contract as specified in the Brochures, etc.
- (3) If you find any discrepancy between the Tour Services provided and those specified in the Brochures, etc. after the start of the tour, you must immediately report the said discrepancy to either the tour conductor, local guide, local agent, or the relevant Tour Service provider at the tour destination.
22.Optional Tours
- (1) Any mini tour ("Optional Tour") conducted for the travelers participating in our package tours for a separate tour fee will be treated as part of the main Tour Contract with respect to the application of the special compensation provisions under Section 20, if such Optional Tour is organized and conducted by us.
- (2) When you participate in an Optional Tour organized and conducted by a party other than us, we will be subject to the Special Compensation Rules under Section 20 but will assume no other liabilities.
23.Itinerary Guarantee

(1) Should any major change occur in the contents of the Tour Contract as stated in the left side column of the following schedule, except for the cases noted in [1] through [3] below, we will pay compensation for changes in the amount calculated by multiplying the tour fee by the rate indicated in the right side column of the schedule within 30 days after the tour end date. However, if it is evident that we will incur a liability as set forth in Section 19 (1) due to said changes, we will pay the amount not as compensation for changes but as either a part or the whole amount of compensation for damages.
- [1] We will not pay compensation for changes when the changes are due to the following reasons, unless they are due to overbooking, where there are insufficient seats, rooms, or other facilities, even though the transportation and accommodation facilities are providing services as usual.
- (a) Inclement weather and natural disasters that hinder the tour itinerary
- (b) War
- (c) Riot
- (d) Orders of public agencies
- (e) Suspension of services provided by transportation and accommodation facilities, etc., such as cancellation, interruption, and cessation
- (f) Provision of transportation services that differ from the original schedule due to delays, interruptions, or changes in operation schedules
- (g) Measures necessary for protecting the life or physical safety of the tour participants
- [2] We will not pay compensation for changes that pertain to a portion of the Tour Contract that has been cancelled in accordance with the provisions of Sections 13 and 14.
- [3] We will not pay compensation for changes when the Tour Services are not provided in the order specified in the Brochures, etc., as long as the said Tour Services have been provided.
- (2) Regardless of the provisions of (1) of this section, the maximum amount of compensation for changes we will pay under a single Tour Contract is 15% of the tour fee. If the amount of compensation for changes payable under a single Tour Contract is less than 1,000 yen, we will not pay compensation for the changes.

Note 3: The schedule does not apply to a change in the transportation facility operator noted in [4] when the change is to a higher class or higher rate facility. Note 4: If a change noted in [4], [7], or [8] occurs multiple times during a single train, vehicle, or ship ride, or a single overnight stay, the change is counted as one per ride or overnight stay. Note 5: The grade of an accommodation facility noted in [7] is as specified in the list shown in the contract document at the time the Tour Contract is entered into or the list available on our website. Note 6: The percentages noted in [1] through [8] do not apply to the changes noted in [9], but those noted in [9] apply. Note 7: Changes are counted as one per ride in the case of a transportation facility, per stay in the case of an accommodation facility, and per service in the case of other Tour Services. - (3) Instead of a monetary payment as compensation for changes, we may, with your consent, provide you with goods or services that are of equal or higher value.
- (4) If, after we have compensated you for a change as stipulated in (1) of this section, it becomes evident that we will incur a liability as set forth in Section 19 (1) due to the said change, you must return to us the said compensation. In such cases, we will pay you compensation for damages in accordance with the provisions of Section 19 after deducting the sum of compensation for changes to be returned by you.
24.Tour Terms and Conditions under Contract by Correspondence
- We may enter into a Tour Contract ("Contract by Correspondence") with a member ("Member") of an affiliated credit card company ("Affiliated Company") under the terms and conditions that we receive payment for a tour fee,cancellation fee, etc. without the Member's signature. The tour terms and conditions of the Contract by Correspondence differ from the standard tour terms and conditions in the following aspects.
- (1) "Card Use Date" in this section means the day on which a Member or we are to perform our obligation to pay or refund a tour fee under the Tour Contract.
- (2) When booking a tour, you will inform Our Company of your membership number (credit card number), expiration date of the card, etc. In case of specific tours, such as Tour Contracts that use individual excursion fares or individual inclusive tour fares offered by airline companies including LCCs, payment of the full amount of the tour fee is required as a deposit. If you fail to inform Our Company of your membership number (credit card number) when booking a tour for which a Contract by Correspondence is required, your booking will be deemed not to have been made.
- (3) The Tour Contract by way of a Contract by Correspondence will be entered into upon your receipt of a notice to the effect that the Tour Contract has been approved.
- (4) Our Company will receive payment of a travel fee, cancellation fee, etc. without the Member's signature on the prescribed voucher using a credit card issued by an Affiliated Company. In such cases, the Card Use Date for the payment of a tour fee is the day on which the contract is entered into.
- (5) If a request for cancelling a contract is made, Our Company will refund the tour fee after deducting the cancellation fee on the Card Use Date, which is within 7 days (or 30 days in the case of a reduction or cancellation after the tour starts) after the said request is made.
- (6) If a payment cannot be made using the credit card selected by a Member due to a credit issue or other reasons, Our Company will cancel the Contract by Correspondence and ask the Member to pay the tour fee in cash by the due date separately specified by Our Company. Failure to make a payment by such due date will result in a penalty equal to the amount of a cancellation fee set forth in Section 13 (1) (i) (a).
25.Standard for Tour Terms and Conditions and Tour Fees
- The relevant dates for these Tour Terms and Conditions and the tour fees are the dates specified in the separately provided Brochures, etc.
26.Notification of Accidents, etc.
- In the event that an accident, etc., occurs during the tour, please notify the contact listed on the finalized itinerary immediately.
(If you cannot contact us due to circumstances, please do so as soon as you become able.)
27.Handling of Personal Information
- We collect specific types of personal information from you when you book a tour. You must consent to our privacy policy as well as how we handle personal information before booking a tour. If you are a representative (contracting person) of a group of travelers, you must obtain the consent of the group members (accompanying persons) to our handling of personal information before booking a tour. We will use personal information obtained from you for contacting you as well as providing you with information about the products and services offered by our partner companies. We will also share your personal information with transportation and accommodation facilities, insurance companies, souvenir shops, etc. to the extent necessary for making travel arrangements and carrying out other procedures.
We also ask for the personal information of a person we can contact in case of illness, accident, etc. while you are on the tour. We will use such personal information only in the event that you become ill or in other circumstances where we deem that contacting such person is necessary. You agree to obtain consent of the said contact person to providing his/her personal information to us.

28.Miscellaneous
- (1) You will be responsible for any expenses incurred when you personally ask the tour conductor to provide a guide, go shopping, etc.; costs arising from your injury, illness, etc.; costs associated with retrieving the baggage that has been lost or articles that have been left behind due to your negligence, and costs incurred for arranging independent activities.
- (2) We may take you to souvenir shops for your convenience, but you are responsible for your own purchase decisions.
- (3) Under no circumstances will we re-conduct a tour.
- (4) By participating in our Agent-Organized Package Tour, you may be eligible for mileage services provided by airlines. You are responsible for contacting the relevant airlines if you wish to make inquiries or sign up for such services. In the event that you are unable to receive the services you have planned to receive due to a change in the airline to be used, we will not be subject to the liabilities set forth in Sections 19 (1) and 23 (1).
- (5) Using airline tickets, accommodation services, meal services, admission tickets, etc. arranged under your contract to make a profit, transferring them to a third party without permission, or reselling them is strictly prohibited. If we deem that you have engaged in such conduct for the purpose of making a profit or any similar conduct, we may cancel your Tour Contract without notice. - (6) Any matters not provided for in these terms and conditions will be in accordance with our Standard Terms and Conditions of Travel Contracts (Agent-Organized Package Tour Contracts).
